Lindsay Lohan was sensationally set to be bailed from jail just hours after being told she would be locked up for a month.
The troubled starlet was booked into the Lynwood jail after Judge Elden Fox on Friday morning made the surprising decision to deny her bail over a probation violation.
Lohan was in court for a hearing after she failed a drug test as part of her DUI probation.
But she was stunned when the judge decided he wanted her locked up until the case is heard on October 22.
The judge then denied a plea for bail at an in-chambers meeting, before lawyer Shawn Chapman Holley scrambled to file an appeal.
With Lohan already in jail, Judge Patricia Schnegg, Assistant Supervising Judge for the L.A. County Criminal Courts, then threw out Judge Fox's bail decision late in the afternoon.
The decision was based on California law which gives defendants the right to bail in misdemeanour cases, according to reports.
She set bail at $300,000.
According to the order, Lindsay will have to get a SCRAM bracelet once again within 24 hours.
Under the terms of her bail, she is not allowed to be around known drug users and must submit to search by law enforcement at any time.
She will also have to stay away from nightclubs – she has been ordered to avoid places where alcohol is the "chief item of sale."
According to US reports she was set to be bailed on Friday night.
